Terms & Conditions
1) Definitions
- "Booking" means your reservation for a tour, excursion, or activity.
 - "Participant" means any person taking part in a booked tour or activity.
 - "Force Majeure" means circumstances beyond our reasonable control, including but not limited to natural disasters, adverse weather, government action, war, terrorism, pandemic, or other events that make it impossible or unsafe to conduct a tour.
 
2) Booking & Payment
- A booking is confirmed once we accept your reservation and, where applicable, payment is received.
 - You must provide accurate and complete information when booking (names, ages, contact details, special requirements).
 - Payment may be required in full or as a deposit (as specified at booking). Final payment may be due before departure or on the day of the tour, as agreed.
 - Prices are in the currency stated (e.g., EUR, MAD). Exchange rates may vary.
 - We reserve the right to refuse service or cancel bookings if payment is not received as agreed.
 
3) Pricing & Inclusions
- Prices are generally per person unless stated otherwise (e.g., "private tour" prices may be per group).
 - What's typically included: guide services, transport (if specified), equipment (if specified, e.g., quad bikes, helmets), hotel pickup/drop-off (if specified).
 - What's typically excluded unless stated: meals, drinks, entrance fees to attractions, tips, travel insurance, personal expenses.
 - We reserve the right to correct pricing errors and adjust prices due to currency fluctuations, supplier changes, or other factors. We will notify you of significant changes.
 
4) Cancellation & Refunds
By you:
- Free cancellation: Many tours offer free cancellation up to 24 hours before the scheduled start time. Check the specific tour page or booking confirmation.
 - Cancellation fees: If you cancel within the cancellation deadline or after the deadline has passed, fees may apply as follows:
                
- More than 48 hours before: Full refund or reschedule (subject to availability).
 - 24–48 hours before: 50% refund or reschedule option.
 - Less than 24 hours before or no-show: No refund.
 
 - Refunds, if applicable, will be processed within 14 business days using the original payment method.
 
By us:
- We reserve the right to cancel a tour due to Force Majeure, insufficient participants, operational issues, or safety concerns.
 - If we cancel, we will offer a full refund, a reschedule, or a credit toward another tour, at your choice.
 - We are not liable for additional costs you may incur (e.g., flights, accommodation) due to our cancellation.
 
5) Changes to Bookings
- You may request changes (dates, number of participants, tour type) subject to availability.
 - Changes requested less than 48 hours before departure may incur fees or may not be possible.
 - We may need to modify routes, itineraries, or inclusions due to weather, safety, or operational reasons. We will notify you as soon as possible.
 - Substantial changes that materially affect your booking may entitle you to cancel and receive a full refund.
 
6) Age & Health Requirements
- Minimum age requirements vary by tour (check tour descriptions). Children must be accompanied by a parent or guardian unless otherwise specified.
 - Participants must be in good physical health suitable for the activity (e.g., quad biking, horse riding, hiking). If you have medical conditions, disabilities, or are pregnant, please inform us before booking.
 - We may refuse participation if we reasonably believe a participant's health or condition poses a risk to themselves or others.
 - Some tours may require completion of a health questionnaire or waiver.
 
7) Safety & Conduct
- Participants must follow our guides' instructions at all times. Failure to do so may result in removal from the tour without refund.
 - You are responsible for your personal safety and the safety of others in your group.
 - Participants must not be under the influence of alcohol or drugs during tours.
 - We provide safety equipment (helmets, life jackets, etc.) where required. You must use it as instructed.
 - If weather conditions or other circumstances make a tour unsafe, we may modify or cancel it. Your safety is our priority.
 
8) Liability & Insurance
- Our liability: We are not liable for personal injury, death, loss, or damage except to the extent caused by our negligence or breach of contract. Our liability is limited to the price you paid for the tour.
 - Your responsibility: You participate in tours at your own risk. Activities such as quad biking, horse riding, camel rides, water sports, and hiking involve inherent risks.
 - Travel insurance: We strongly recommend that you have comprehensive travel insurance covering medical expenses, cancellation, personal liability, and activity-specific coverage (e.g., adventure sports).
 - Third parties: We are not liable for the actions or omissions of third-party suppliers (e.g., transport providers, equipment rental companies), except where we have failed to exercise reasonable care in selecting them.
 - Property damage: You are liable for damage to equipment, vehicles, or property caused by your negligence or misuse.
 
9) Passports, Visas & Health
- You are responsible for ensuring you have valid passports, visas, and any required health documents (e.g., vaccinations) for entry into Morocco and participation in tours.
 - We are not responsible if you are denied entry or participation due to documentation issues.
 
10) Photography & Marketing
- We or our guides may take photographs or videos during tours. By participating, you consent to the use of these images for marketing purposes (website, social media, promotional materials) unless you notify us otherwise in writing at the time of booking.
 - You may take your own photos but must respect privacy and local customs.
 
11) Complaints & Disputes
- If you have a complaint during a tour, please inform your guide immediately so we can try to resolve it.
 - If you have a complaint after a tour, please contact us via the contact page or call +212 601-820422 within 14 days.
 - We will investigate and respond within a reasonable time. We are committed to resolving issues fairly.
 - These Terms are governed by the laws of Morocco. Any disputes will be subject to the exclusive jurisdiction of the courts of Morocco.
 
12) Intellectual Property
All content on our website (text, images, logos, design) is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use our content without permission.
13) Website Use
- You agree to use our website lawfully and not to misuse it (e.g., hacking, spreading malware, unauthorized access).
 - We may update or withdraw our website at any time without notice.
 - Links to third-party websites are provided for convenience. We are not responsible for third-party content or policies.
 
14) Changes to These Terms
We may update these Terms & Conditions from time to time. The "Last updated" date indicates the most recent changes. Your booking is subject to the terms in effect at the time of booking.
