1) Company Information

These Terms & Conditions apply to all bookings made with The Local Guide ("the Company", "we", "us", "our").

By booking a tour or activity with us, you agree to be bound by these Terms & Conditions.

2) Booking & Payment

• All bookings can be made online through our website or partners.
• Full payment is required at the time of booking to confirm your reservation.
• Payments are accepted in EUR and MAD.
• We may also accept cash payments upon arrival when agreed in advance.
• Once payment is completed, you will receive a confirmation via email or WhatsApp.

3) Cancellation & Refund Policy

• Customers may cancel their booking free of charge up to 24 hours before the scheduled start time.
• Cancellations made less than 24 hours before the activity are non-refundable.
• No-shows (failure to attend without notice) are non-refundable.
• Refunds, when applicable, will be processed using the original payment method.

4) Changes & Modifications

• Customers may request changes to the date, time, or activity, subject to availability.
• We reserve the right to modify or cancel activities due to operational reasons, safety concerns, or unforeseen circumstances.
• In such cases, customers will be offered an alternative date or a full refund.

5) Weather & Force Majeure

• In case of unsuitable weather conditions or events beyond our control, including natural events, government restrictions, or safety risks, the activity may be rescheduled or fully refunded.
• We are not liable for additional costs incurred, including transport or accommodation.

6) Pick-up & Timing Policy

• Customers must be ready at the agreed pick-up location and time.
• We allow a maximum waiting time of 15 minutes.
• If the customer is not present within this time, it will be considered a no-show and no refund will be issued.

7) Safety & Participation

• All activities are undertaken at the participant's own risk.
• Customers must follow all safety instructions provided by guides and staff.
• We reserve the right to refuse participation to anyone under the influence of alcohol or drugs, or behaving dangerously.

8) Children Policy

• Minimum age to drive a quad bike: 16 years.
• Minimum age for jet ski: 18 years.
• Participants below these ages may join only as passengers with an adult.
• Parents or guardians are responsible for minors at all times.

9) Health Conditions

• Customers must inform us in advance if they have any medical condition that may affect participation, including pregnancy, back problems, or heart conditions.
• We reserve the right to refuse participation for safety reasons.

10) Liability Disclaimer

• We are not responsible for loss or damage to personal belongings.
• We are not responsible for injuries resulting from personal negligence or failure to follow instructions.
• Customers are responsible for arranging their own personal travel insurance.

11) Governing Law

These Terms & Conditions are governed by the laws of the Kingdom of Morocco. Any disputes shall fall under the jurisdiction of the courts of Agadir.
